Submitting a DMCA Takedown Notice
If you believe that content on our services infringes your copyright, please send a written notice that includes all of the following:
- Your physical or electronic signature;
- Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are involved;
- Identification of the material you claim is infringing, including its location on our services (such as a URL or specific description);
- Your contact information, including your name, address, telephone number, and email address;
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.
We may not be able to respond to notices that are incomplete or unclear.
Submitting a Counter-Notification
If your content has been removed or access has been disabled as a result of a DMCA notice and you believe it is not infringing, or that you have the right to use it, you may send us a counter-notification that includes:
- Your physical or electronic signature;
- Identification of the material that has been removed or to which access has been disabled, and the location where it appeared before removal or disabling;
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification; and
- Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your judicial district (or, if outside the United States, to any judicial district in which we may be found) and that you will accept service of process from the person who provided the original DMCA notice or their agent.
If we receive a valid counter-notification, we may restore the removed material unless we receive notice that the original complaining party has filed a court action seeking to restrain you from engaging in infringing activity.
Repeat Infringers
In appropriate circumstances and at our reasonable discretion, we may suspend, limit, or terminate access to our services for users who are determined to be repeat infringers.
Misrepresentation
Under the DMCA, any person who knowingly misrepresents that material or activity is infringing (or, conversely, that material was removed or disabled by mistake or misidentification) may be liable for damages, including costs and attorneys’ fees. Please submit DMCA notices and counter-notifications carefully.
